{"id":16996,"date":"2013-03-26T09:39:16","date_gmt":"2013-03-26T16:39:16","guid":{"rendered":"http:\/\/www.amptoons.com\/blog\/?p=16996"},"modified":"2013-03-26T13:54:41","modified_gmt":"2013-03-26T20:54:41","slug":"scotusblog-predicts-a-modest-victory-for-prop-8-opponents-in-the-supreme-court","status":"publish","type":"post","link":"https:\/\/amptoons.com\/blog\/?p=16996","title":{"rendered":"SCOTUSblog Predicts A Modest Victory For Prop 8 Opponents In The Supreme Court"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/www.amptoons.com\/blog\/wp-content\/uploads\/2013\/03\/MarriageCenter_PopulationPolling2-465px.jpg\" alt=\"\" title=\"MarriageCenter_PopulationPolling2-465px\" width=\"465\" height=\"320\" class=\"aligncenter size-full wp-image-16997\" \/><\/p>\n<p><em><strong>UPDATE<\/strong>: <a href=\"http:\/\/www.towleroad.com\/2013\/03\/heres-audio-of-todays-prop-8-arguments-before-the-supreme-court-listen.html\">Towelroad <\/a>has an audio recording of today&#8217;s oral arguments, and also a transcript.<\/em><\/p>\n<p>Tom Goldstein of the highly respected SCOTUSblog was in the audience for the Supreme Court&#8217;s oral arguments today in the Proposition 8 case, and <a href=\"http:\/\/www.scotusblog.com\/2013\/03\/the-proposition-8-oral-argument\/\">came away with some predictions<\/a>.<\/p>\n<blockquote><p>&#8230;Justice Kennedy seemed very unlikely to provide either side with the fifth vote needed to prevail.  He was deeply concerned with the wisdom of acting now when in his view the social science of the effects of same-sex marriage is uncertain because it is so new.  He also noted the doubts about the petitioners\u2019 standing.  So his suggestion was that the case should be dismissed.<\/p>\n<p>If those features of the oral argument hold up \u2013 and I think they will \u2013 then the Court\u2019s ruling will take one of two forms.  First, a majority (the Chief Justice plus the liberal members of the Court) could decide that the petitioners lack standing.  That would vacate the Ninth Circuit\u2019s decision but leave in place the district court decision invalidating Proposition 8.  [&#8230;]<\/p>\n<p>Second, the Court may dismiss the case because of an inability to reach a majority.   Justice Kennedy takes that view, and Justice Sotomayor indicated that she might join him.  Others on the left may agree.  That ruling would leave in place the Ninth Circuit\u2019s decision.<\/p>\n<p>The upshot of either scenario is a modest step forward for gay rights advocates, but not a dramatic one.<\/p><\/blockquote>\n<p>Although it&#8217;s not the sweeping victory SSM advocates want, overturning Prop 8 would still be a big deal. Currently, 16% of Americans live in states where same-sex marriage is legal. If California is added, that number will almost double, to 28%.<\/p>\n<p>Tomorrow, the Supreme Court will hear oral arguments on the Defense Of Marriage Act. It&#8217;s widely expected that the court will find DOMA&#8217;s ban on the federal government recognizing SSM to be unconstitutional.<\/p>\n<p><strong>UPDATE<\/strong>:<\/p>\n<blockquote><p>JUSTICE SCALIA:  When did it become unconstitutional to ban same-sex marriage?  Was it 1791?  1868?<\/p>\n<p>TED OLSON:  When did it become unconstitutional to ban interracial marriage?<\/p>\n<p>JUSTICE SCALIA:  Don&#8217;t try to answer my question with your own question.<\/p><\/blockquote>\n<p>UPDATE TO THE UPDATE:<\/p>\n<p>The above was a paraphrase from a witness, but the actual transcript isn&#8217;t so bald:<\/p>\n<blockquote><p>JUSTICE SCALIA: I\u2019m curious, when -\u00ad when did \u2014 when did it become unconstitutional to  exclude homosexual couples from marriage? 1791? 1868, when the Fourteenth Amendment was adopted? Sometimes \u2014 some time after Baker, where we said it didn\u2019t even raise a substantial Federal  question? When \u2014 when \u2014 when did the law become this?<\/p>\n<p>MR. OLSON: When \u2014 may I answer this in the  form of a rhetorical question? When did it become  unconstitutional to prohibit interracial marriages?  When did it become unconstitutional to assign children  to separate schools.<\/p>\n<p>JUSTICE SCALIA: It\u2019s an easy question, I  think, for that one. At \u2014 at the time that the Equal  Protection Clause was adopted. That\u2019s absolutely true. But don\u2019t give me a question to my question.
