{"id":19204,"date":"2014-10-16T02:07:13","date_gmt":"2014-10-16T09:07:13","guid":{"rendered":"http:\/\/amptoons.com\/blog\/?p=19204"},"modified":"2014-10-16T02:08:10","modified_gmt":"2014-10-16T09:08:10","slug":"please-stop-saying-that-judges-in-texas-and-dc-said-theres-a-free-speech-right-to-take-upskirt-shots","status":"publish","type":"post","link":"https:\/\/amptoons.com\/blog\/?p=19204","title":{"rendered":"Please stop saying that judges in Texas and DC said there&#8217;s a free speech right to take upskirt shots"},"content":{"rendered":"<p><a href=\"http:\/\/lacigreen.tumblr.com\/post\/100015557860\/just-literally-cannot-with-these-judges-brb\">Laci Green<\/a>, a feminist sex educator, produced this graphic:<\/p>\n<p><a href=\"http:\/\/lacigreen.tumblr.com\/post\/100015557860\/just-literally-cannot-with-these-judges-brb\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/amptoons.com\/blog\/wp-content\/uploads\/2014\/10\/laci-green-upskirt-graphic.png\" alt=\"laci-green-upskirt-graphic\" width=\"500\" height=\"479\" class=\"aligncenter size-full wp-image-19205\" \/><\/a><\/p>\n<p>Laci (whose work I&#8217;m generally a fan of) isn&#8217;t alone; a <a href=\"http:\/\/www.huffingtonpost.com\/2014\/10\/10\/upskirt-photos-legal-dc_n_5966406.html\">lot <\/a>of blogs and news outlets<a href=\"http:\/\/www.wjla.com\/articles\/2014\/10\/judge-rules-man-who-took-photos-up-ladies-skirts-at-lincoln-memorial-didn-t-violate-their-privacy-10.html\"> have said<\/a> &#8211; often in clickbaity headlines &#8211; that rulings in Texas and DC <a href=\"http:\/\/thinkprogress.org\/culture\/2014\/10\/10\/3578895\/in-light-of-the-upskirt-ruling-some-fashion-tips-for-ladies\/\">recognize <\/a>a First Amendment right <a href=\"http:\/\/www.theguardian.com\/world\/2014\/sep\/19\/texas-court-upholds-right-to-take-upskirt-photos\">to take<\/a> upskirt <a href=\"http:\/\/www.breitbart.com\/Breitbart-Texas\/2014\/09\/19\/Texas-Court-Ban-on-Upskirt-Photos-Violates-First-Amendment\">shots <\/a>of non-consenting <a href=\"http:\/\/www.salon.com\/2014\/09\/18\/texas_court_throws_out_upskirt_photo_law_because_banning_creepshots_is_paternalistic\/\">women<\/a>. <\/p>\n<p>That&#8217;s not what either judgement said. And it&#8217;s damaging when alarming but false stories like these spread.<\/p>\n<p>There are a thousand crucial problems for feminists to be concerned with &#8211; the wage gap, the high prevalence of rape, revenge porn, the caregiving gap, sexual harassment, street harassment, attacks on reproductive rights, and I could go on and on. It doesn&#8217;t benefit feminism or women when feminists pass around mistaken information; on the contrary, it leads to energy and anger being misdirected.<\/p>\n<p>The Texas judgement (<a href=\"http:\/\/www.popehat.com\/wp-content\/uploads\/2014\/09\/Thompson-Decision.pdf\">pdf link<\/a>) said that the law they overturned was unconstitutional because it was overbroad &#8211; that is, the law was so broadly written that it could apply to a bunch of constitutionally protected photos, rather than focusing narrowly on upskirt shots (for instance, the judge wrote &#8220;this statute could easily be applied to an entertainment reporter who takes a photograph of an attractive celebrity on a public street&#8221;). In fact, the ruling flat-out said that a narrow law banning upskirt shots <em>would <\/em>be constitutional:<\/p>\n<blockquote><p> We agree with the State that substantial privacy interests are invaded in an intolerable manner when a person is photographed without consent in a private place, such as the home, or with respect to an area of the person that is not exposed to the general public, such as up a skirt.
