{"id":898,"date":"2004-06-08T07:41:23","date_gmt":"2004-06-08T15:41:23","guid":{"rendered":"http:\/\/www.amptoons.com\/blog\/archives\/2004\/06\/08\/just-another-bush-administration-hypocrisy\/"},"modified":"2004-06-08T07:41:23","modified_gmt":"2004-06-08T15:41:23","slug":"just-another-bush-administration-hypocrisy","status":"publish","type":"post","link":"https:\/\/amptoons.com\/blog\/?p=898","title":{"rendered":"Just Another Bush Administration Hypocrisy"},"content":{"rendered":"<p><a href=\"http:\/\/www.talonnews.com\/news\/2004\/june\/0602_pbabortion_ruling.shtml\">What one Bush official said <\/a>about the judge&#8217;s ruling in the Partial-Birth Abortion Ban case:<\/p>\n<div class=\"snip\">Bush-Cheney reelection campaign chairman Marc Racicot said the ruling is a prime example of &#8220;why American needs judges who will interpret the law and not legislate from the bench.&#8221;<\/div>\n<p>In fact, the Bush administration&#8217;s lawyers <i>begged<\/i> this judge to legislate from the bench. According to the judge&#8217;s ruling (p. 30 &#8211; <a href=\"http:\/\/news.findlaw.com\/nytimes\/docs\/abortion\/ppash60104ord.pdf\">pdf file<\/a>), the law written by congress was too broad to be constitutional, so the administration&#8217;s lawyers  asked Judge Hamilton to &#8220;narrow the construction of the statute to eliminate any doubts about the Act\u2019s unconstitutionality.&#8221; The judge quite properly refused to do so, since her job is to rule on the law, not to rewrite it.<\/p>\n<p>So first they beg a judge to legislate from the bench. Then, when she refuses to do it, they turn around and criticize her for legislating from the bench (which she didn&#8217;t do).
