    I don’t know about that Feminste logo. Even I couldn’t fire a shotgun with a pistol stock holding it like that, and it’s a pump action which is going to be pretty hard for someone with her arm length and upper body strength to operate. That kid needs an autoloading .410. Remember; gun control means hitting what you’re aiming at.

    Maybe I should pass my objections along on the site. What do you think?

    I liked the posting on Burris. Of course, ultimately the Governor signs the death warrant but if what’s on there is true it wouldn’t surprise me.

    The unfortunate reality is that her statement regarding legality is not really true. Mind you, this is most assuredly not a good thing. But I think it’s important when discussing laws to distinguish between “should be” and “is.” So when she says this:

    For sex to be consensual and legal there needs to be a clear presence of freely and legally given consent.

    That is wrong. We don’t generally define that which is legal; we only define what is illegal IOW, most laws (including rape laws) don’t talk about what you CAN do, they only talk about what you CAN’T do. If you want to know if a behavior is OK, you don’t try to find a law permitting it; you try to find a law prohibiting it and if you can’t find one then it’s legal.

    So technically there is often no such thing as “legal” sex–there is only “non-illegal” sex. Similarly, the definition of legality is always skewed towards the defendant, so it’s really a problem of proving lack of consent.

    So Marcella’s sentence is backwards.

    She says “Legal = clear presence of consent.”

    but in fact it should be “Legal = non-illegal = no clear presence of non-consent.”

    Confusing? Yes. But it is a crucial distinction, because it serves to illustrate the problem with rape law and with criminal codes in general: Lots of behavior which is BAD (like non-freely-consented-to sex) may still be LEGAL.

    Contrary to what the linked article says, the Prisoner wasn’t constantly trying to discover the identity of the elusive Number Two; he met multiple Number Twos. He was trying to discover the identity of Number One.

    Nice try, Amp, but I’m not falling for that faux linked article. And since you linked to it, you’re obviously part of the plot.

    I don’t expect you to agree with everything I write. But I hope nothing in this series will actually piss you off. And I really hope you find some of the comments on that first post (not Holly’s — folks like Shah8 and that crowd) as upsetting as I have.
